When you book a holiday or a safari with Brightdays Safaris, you will be entitled to some rights which we would like you to understand by reading this page carefully. We consider that once you remit your safari deposit to us, you have agreed to these "Terms & Conditions" and as per the 'Inclusions & Exclusions' stipulated on your itinerary. Please take your time to read them carefully. |

TERMS AND CONDITIONS OF BOOKING |
| |
These terms and conditions govern the relationship between Brightdays Safaris and you. To the total exclusion of any other terms and conditions. No alterations to the terms and conditions may be made by any unauthorized employee of Brightdays Safaris authorized representatives or agents, unless in writing by an authorized employee of Brightdays Safaris. All decisions and matters subject to the discretion of Brightdays Safaris shall be made by an authorized officer or employee of Brightdays Safaris. |

RESERVATIONS AND PAYMENTS |
| |
(A) Reservations should be made by contacting Brightdays Safaris. Safaris are booked and confirmed only on receipt of a 35% advance payment of the basic safari rate. This advance payment is due within five (5) days of making the reservation. |

(B) There shall be no binding contract until the advance payment has been received by Brightdays Safaris. |
| |
(i) If you prefer to charge your safari payments, you are welcome to fax or e-mail us the details of your credit card, which should include the following: |
| |
a) Type of credit card
b) Name of cardholder (as it appears on the card)
c) The billing address of the cardholder
d) Card number
e) Expiration date
f) Our invoice number |

C) The balance is due no later than twenty one (21) days prior to commencement of your safari. If the balance has not been received by that date, Brightdays Safaris shall be entitled in its discretion to treat your reservation as canceled, and consequently to forfeit such part of the advance payment as determined solely by Brightdays Safaris. |

D) Brightdays Safaris will not provide tickets, coupons, vouchers or documents until full payment has been received by Brightdays Safaris. |
| |
E) Brightdays Safaris will not accept responsibility for wire transfer and / or overnight mail charges. |
| |
F) Special airfares are capacity controlled and often sold out months in advance. In addition, many accommodations offered to Brightdays Safaris have a limited capacity. It is essential to make reservations well in advance to insure your preferred arrangements. |

Rates |
| |
All prices are normally net unless otherwise specified & are subject to change only due to unavoidable circumstances. Flights to and from Africa are NOT included in the cost of the safaris in the itineraries. Brightdays Safaris will confirm all prices before you book your holiday. Your holiday dossier will naturally indicate what is and what is not included in the tour price. |

Payment A booking deposit of 35% of the full charges is payable. The balance must reach us in our Nairobi office not less than 21 days prior to the commencement of the tour. |

Alterations to Tours |
| |
The right is reserved to change any route or arrangements should conditions necessitate and to offer substitutes of equal value or to cancel the operation of any scheduled tour. The right is also reserved to decline to accept or retain any person as a member of any tour at any time, in which event an equitable amount will be refunded. |
| |
Cancellation / No Show Fees If you wish to cancel or alter your Booking you must do so in writing in which event a fee or percentage will be charged, calculated with reference to the date of receipt of notification in writing, or fax or telex by Brightdays Safaris. These fees and any other expenses will be charged in accordance with the costs incurred by our company. |

Refunds |
| |
In the event of the receipt of notice of a total cancellation 40 or more days prior to the commencement of a tour, a full refund will be made, less cancellation fees imposed by lodges, hotels, transportations etc. and any disbursement and administration expenses incurred by us. |

If notice of the cancellation is received less than 4 days prior to the commencement of the tour, Brightdays Safaris will reserve the right to retain full payment. |
| |

| |
Cancellation Charges |
| |
Earlier than 30 days before departure will require 75% of deposit to be forfeited |
| |
30 to 2 days before departure will require the full deposit to be forfeited
No show and between 2 days and the time of departure shall forfeit the full price of the tour. |
| |
Once the tour has started, no refunds shall be made in any manner or for any reasons. |
| |
Brightdays Safaris reserves the right at anytime and without incurring any liability whatsoever or howsoever to make changes to your Tour arrangements (including flights, accommodation, transport or services), to offer substitute facilities (in Brightdays Safaris’ view) of equal value and reputation, or to cancel any scheduled Tour. |
| |
If we cancel the Tour we shall make a full refund except in respect of any cancellation caused by war or threat of war, insurrection, riots, strikes, civil actions, decisions by governments or governing authority, natural disaster, bad weather, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers or other similar circumstances beyond our control. |

ACCOMMODATION |
| |
Without any acceptance of liability for failure to do so, Brightdays Safaris shall endeavor to book rooms for you with private baths on the basis of two persons sharing a double room. Single rooms shall be available at a supplementary price. However Brightdays Safaris does not guarantee the availability of either a private bathroom or a single bedroom, even where a private bathroom or a single bedroom had been specifically requested by you. |

Whilst Brightdays Safaris will use its best endeavors to ensure that you stay in the hotel, lodge, or camp of your choice, it reserves the right to alter the identity of your destination provided that it shall reserve rooms for you in hotels / lodges / camps which, in its view, are of similar value and standing which have been declined by you. |

TRANSPORTATION AND GUIDES |
| |
Brightdays Safaris shall provide such aircraft, safari minibuses, safari cruisers, cars, four-wheel vehicles or coaches as it considers necessary to transport you, based on considerations such as the route to be taken, the conditions of the roads and the number of clients on the proposed journey. Brightdays Safaris reserves the right to alter any such arrangements made, including the proposed route to be taken. |

Brightdays Safaris reserves the right to employ the services of sub-contractors to effect your transportation.
Brightdays Safaris shall provide the services of a driver-guide. |

| |
Liability / Responsibility |
| |
Whilst care is taken for the security, safety and comfort of our clients these are adventure safaris and there are certain possibilities of dangers and risks to our clients, which are inevitable. The company accepts NO liability for all the following: |
| |
a) Sickness, infection, injury or death of any of the clients howsoever caused
b) Damage to or loss of any of the property of any client howsoever caused |
| |
Brightdays Safaris and associated companies accept no responsibility for losses or additional expenses due to delays, or changes, in train, motor, air or other services, sickness, weather, strikes, civil disturbances, war, quarantine or other cause. All such losses or expenses will have to be borne by the passenger.
Such conveyance etc is subject to the laws of the country in which the tour takes place and all claims are subject only to the jurisdiction of the courts of the country in which the cause of action arises.
Brightdays Safaris reserve the right to employ subcontractors to carry out all, or part, of the services provided.
Baggage and personal effects are carried at owner's risk and clients are cautioned against the risk of leaving them unattended.
In order to secure best available ground services a deposit equivalent to 35% of the tour price is required at the time of booking. Additional payments are required prior to the start of the safari, with full payment not less than 21 days prior to the safari. |

YOUR RESPONSIBILITIES |
| |
You shall ensure that you have obtained adequate insurance cover against personal accident, medical expenses and loss of your baggage.
You shall ensure that all your travel documents, full passports, visas, vaccination certificates, currency and traveler’s cheques are in order and that the name that appears on your airline ticket (if relevant) shall be the name that appears on your passport and that you reconfirm all your international flights departures, at least 72 hours prior to departure, unless Brightdays Safaris shall have agreed by prior arrangement to reconfirm on your behalf. |

You shall be responsible for informing Brightdays Safaris when the Booking is made of any request for special diets or facilities for the disabled or for any other special needs. Whilst every effort will be made to meet such request, Brightdays Safaris does not guarantee that such requests will be met.
You shall inform Brightdays Safaris when you make the Booking of any medical condition or disability which may materially affect your ability to enjoy or suitability for the Tour. |

• Driver / guides who are trained and experienced English speaking.
• Full board accommodation including vegetarians.
• Tents, Mattresses, Sleeping Bags.
• Game drives and all park fees.
• Bed and breakfast in Nairobi.
• Pick–up and drop–off at the airport. |
